Terms and Conditions of Service
Denial of Service

Fix My Busted Computer reserves the right to refrain from providing any or all services and instead refund the payment if payment was made, wholly or in part, to the customer on any basis including but not limited to issues where the requirements are unusual or too extensive and beyond the scope of our service agreement as interpreted by any member of Fix my Busted Computer.


Service Agreement

By agreeing to service through the invoice, the customer agrees to authorize Fix My Busted Computer to perform support and repair services on the customer's computer. The customer agrees and authorizes any employees and contractors of Fix My Busted Computer to examine, diagnose, service, repair or make changes to any software or hardware within the scope of work to be performed to resolve issues on the client's computer.


Description of Services

Before any service(s), an work order will be created for the potential customer providing a list of services to be performed. The work order will list all services to be rendered upon agreement of customer by signature. This agreement encompasses all details of the service, including the Performance Inventory Service package.


Limited Service Warranty

All services of Fix My Busted Computer come with a 14 day guarantee. Details can be found at the Fix My Busted Computer Guarantee page. Work provided by Fix My Busted Computer will be equal or superior to other service providers in the same field. Fix My Busted Computer can not warranty any problems resulting from defective hardware in addition to software not able to be reproduced by the customer.


Denial of Access and Warranty Termination

By purchasing any of remote services provided by Fix My Busted Computer the customer agrees to allow the technician(s) from Fix My Busted Computer remote access to the customer's computer and all files within. Access is allowed on the conditions of the service details of the service(s) listed on the customer's invoice, including the Performance Inventory Service package. The technician(s) may share findings while connected for problem solving or training purposes with other authorized members of Fix My busted Computer. The technician(s) connected to the customer's computer will only access files necessary for the completion of the service(s) listed.

On occasion, the files required to access for service completion may be defined by the customer as private. The customer has the right at any time to deny access to any or all technician(s) performing the service(s) requested. Denial of access to any files on the customer's computer by the customer may inhibit the technician(s) from Fix My Busted Computer from fixing the requested problem and completing the requested service(s). If such a case occurs, our Guarantee becomes void and the customer will be charged for the full amount of the service(s) initially requested.


Data Loss Policy

Fix My Busted Computer will do everything in its power to protect and secure the customer's data from damage or loss. However, The customer is responsible to back up any and all data before bringing the computer in for service or repair. Fix My Busted Computer is not liable for lost data of any kind. This includes any data loss or corruption due to circumstance beyond the control of Fix My Busted Computer including, but not limited to Internet Service Provision failure, omissions by the customer, failure to cooperate by the customer, natural disaster, intentional or unintentional destruction by any persons, events, or authoritative body. By agreeing to service, the customer understands and accepts that it is their (the customer's) responsibility to protect and back up all data deemed important to the customer.


Termination of Service

Service may be denied by the customer before invoice acceptance and payment at no charge. Once the customer's credit card has been charged, Fix My Busted Computer is obligated to perform the selected services. If, at any time after invoice acceptance and payment, the customer wishes to cancel service, service will be cancelled and no refund will be given unless the problem could not be solved by Fix My Busted Computer and the problem deemed a non-hardware related issue.


Amendment

The service contract may be modified or amended in writing and must be listed under the external service notes if agreed upon by both the customer and Fix My Busted Computer. By accepting the invoice and completing payment, the customer also agrees to any and all amendments made in the external service notes.


Severability

If any provision of the Terms & Conditions set forth by Fix My Busted Computer are held to be invalid or unenforceable for any reason, the remaining provisions will continue to be valid and enforceable. If a court finds that any provision of the Terms & Conditions set forth by Fix My Busted Computer is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision will be deemed to be written, construed, and enforced as so limited.
